General Warranty and Support Policy

INTRODUCTION

TECHNICAL PERFORMANCE S.A. (“TECHNICAL PERFORMANCE”), authorized licensee for specific DEWALT® product categories in certain territories of Latin America, issues this General Warranty and Support Policy to set out the general guidelines applicable to products marketed under the DEWALT® brand.
The specific warranty conditions may vary depending on the country, product category, applicable local legislation, type of buyer, sales channel, and the conditions stated at the time of purchase.
This Policy does not replace or limit any non-waivable rights that may correspond to the buyer, consumer, or user under the applicable legislation in each jurisdiction. In the event that mandatory legal provisions grant broader rights, such provisions shall prevail over any limitation contained in this Policy.

Warranty scope

This warranty exclusively covers manufacturing, material, or workmanship defects detected under normal conditions of product storage, handling, and use.
The warranty shall apply only to products purchased through authorized distributors, representatives, or sales channels.
Warranty coverage shall be limited exclusively to the affected product and shall not include indirect, incidental, or consequential damages resulting from its use.

Type of Buyer and Purchase Channel

Warranty and support conditions may vary depending on whether the buyer is an end consumer, company, distributor, institutional buyer, professional user, or any other party in the supply chain.
In all cases, the warranty request must initially be managed through the distributor, representative, retailer, marketplace, or authorized channel where the purchase was made, unless the applicable legislation establishes a different procedure.

EXCLUSIONS

The warranty shall not cover damages, defects, or deterioration caused by:

  • Improper or negligent use.
  • Use contrary to the manufacturer’s instructions.
  • Unauthorized modifications or alterations.
  • Repairs carried out by unauthorized third parties.
  • Normal wear resulting from regular use.
  • Accidents, impacts, cuts, or abrasions.
  • Exposure to chemical, thermal, or environmental agents that are incompatible with the intended use.
  • Improper storage.
  • Use outside the recommended applications.
  • Failure to comply with the maintenance conditions specified for each product.

Personal Protective Equipment and Workwear

In the case of personal protective equipment, industrial safety products, or workwear, the warranty exclusively covers manufacturing defects.
The warranty does not constitute a permanent performance certification, nor does it imply that the product will indefinitely maintain its protective characteristics.
The effective service life of a product will depend on factors such as:

  • Intensity of use.
  • Environmental conditions.
  • Exposure to specific risks.
  • Maintenance.
  • Storage.

It is the user’s responsibility to periodically verify the condition of the product and replace it when necessary.
The information published on the Website, in catalogs, or in commercial materials does not replace risk assessment, instructions for use, technical data sheets, applicable local regulations, or the involvement of qualified professionals in occupational health and safety, risk prevention, or equivalent technical areas.
The user, employer, buyer, or safety manager must verify that the product is suitable for the risk, task, environment, industry, intensity of use, and applicable regulations before use.

Warranty Claim Procedure

All requests must be managed through the authorized distributor or sales channel through which the product was purchased.
To initiate a warranty evaluation, the following may be required:

  • Invoice or proof of purchase.
  • Photographs of the product.
  • Detailed description of the issue.
  • Lot number or product identification, when applicable.
  • Physical sample for technical inspection.

Insufficient documentation may prevent the claim from being evaluated.

Technical Evaluation

TECHNICAL PERFORMANCE, the corresponding manufacturer, or the authorized distributor may carry out technical inspections in order to determine:

  • The existence of a manufacturing defect.
  • Compliance with the recommended conditions of use.
  • The applicability of the warranty.

The technical determination issued as a result of such evaluation shall constitute the basis for the resolution of the claim.

CLAIM RESOLUTION

When a request is approved, TECHNICAL PERFORMANCE S.A., the corresponding manufacturer, or the authorized channel involved may implement, as applicable according to the technical evaluation, product availability, applicable commercial conditions, and current legislation, one of the following solutions:

  • Repair the product, when technically possible.
  • Replace the product with an identical or equivalent product, subject to availability.
  • Replace defective components.
  • Issue a credit note or equivalent commercial solution, when applicable.
  • Implement another reasonable solution in accordance with the technical evaluation and applicable legislation.

The applicable solution may vary depending on the country, product category, purchase channel, stock availability, and corresponding legal framework.

Limitation of Liability

The total liability arising from any applicable warranty shall in no case exceed the original purchase value of the product subject to the claim.
TECHNICAL PERFORMANCE shall not be liable for:

  • Loss of production.
  • Lost profits.
  • Operational interruptions.
  • Indirect or consequential damages.
  • Third-party claims.
  • Costs associated with the temporary replacement of equipment or products.

Applicable law

This Warranty and Support Policy shall be interpreted together with the legislation in force in the country where the product has been marketed.
Where mandatory legal provisions grant broader rights to the buyer, such provisions shall prevail over any limitation contained in this Policy.

CHANGES TO THIS POLiCY

TECHNICAL PERFORMANCE may modify this Warranty and Support Policy at any time.
Modifications shall become effective upon publication on the DEWALT® website.
